HMRC have updated their guidance on 'Posted Workers' which ensures that employees sent from one EEA country to another will have the same rights as domestic employees. You can read the full guidance here.
The guidance sets out the rights available to employees being sent from an EEA country to the UK. The key statement is:
"If you are a posted worker in the UK you are entitled to the same rights as UK workers, including the following statutory employment rights:

The new Directive will require employers to complete an assessment to ensure that the enhanced requirements have been met. This may include an exercise to understand what is included in each Member States pay requirements, as well as adopting a process to pay “top ups” for the period of the posting in the event that the home country remuneration does not correspond to the requirements in the host Member State.
